Contested Divorce & Uncontested Divorce

The first step to getting a divorce in Florida is to file for Dissolution of Marriage. Divorce can be a emotionally difficult for all parties involved, so it is important to have an attorney with the experience and skill to make it as easy and efficient as possible. Carmen G. Soto, Esq. has over thirteen years of experience helping clients navigate the legal process. She is committed to helping South Florida families protect their children, property, and way of life. Located conveniently in the heart of downtown Fort Lauderdale, Carmen G. Soto, P.A. is available to answer your questions and calm your fears about divorce.

Florida is a "no-fault" state when it comes to divorce. This means that Florida courts do not blame or punish either party for causing or seeking a divorce. Under most circumstances, Florida courts will not consider factors like extramarital affairs or other such bad behavior in deciding whether to grant a divorce. There are essentially only two requirements for divorce in Florida: at least one of the parties must be a resident of Florida for six months prior to filing; and the marriage must be irretrievably broken. It is the policy of the State of Florida to encourage married couples to stay together and to offer parties every opportunity to safe a marriage. Either spouse can file for a divorce, and the court does not favor the Petitioner.

There are two main types of divorce in Florida: divorces may be contested or uncontested. An uncontested divorce is one in which both parties agree as to all of the issues in the divorce. The specific issues in each divorce depend on the parties. Uncontested divorces are generally less stressful for everyone involved and faster than a contested divorce. Uncontested divorces allow spouses to make important decisions about their family without ever going to court. Regardless of whether or not the parties agree to an uncontested divorce, it is important to seek advice from a Florida divorce attorney before or during the divorce process to help identify all of the important issues and protect your rights.

If you and your spouse cannot agree on all of the issues in your divorce, your divorce is contested. Even reasonable people may disagree about one thing or another. When you and your spouse file a contested divorce it may take months or even years for a complete resolution. These cases often proceed to trial where a judge makes a final decision about whatever the parties could not agree on.

No matter whether you are filing a contested or uncontested divorce, it is paramount for you to seek advice from a licensed Florida family law attorney who can provide necessary support and information to ensure that the process goes as smoothly as possible. Carmen G. Soto, is an excellent attorney. She is very patient, knowledgeable, professional and my favorite.... flexible with payment plans. I was in need of an attorney to secure my sons future, and Carmen with her knowledge and experience provided the support we needed. I can honestly say that as a man/father we never get a fair chance in the courtrooms concerning family matters but Carmen made sure the Court systems saw past that stigma and justice was rightfully served. I would highly recommend Carmen G. Soto and her staff. Anonymous

Never having to use an attorney before, I was quite nervous and skeptical about my first meeting. Carmen Soto, not only made my first experience very comfortable, but was very informative and quite knowledgeable in the field of family law and divorce. She was there every step of the way for me as a support system, and her confidence and expertise made my otherwise very difficult situation, a very positive one. I highly recommend Carmen Soto. She is an excellent and compassionate attorney who clearly outlines all your options and takes a personal interest in your individual situation. Anonymous
